STALLION BREEDING CONTRACT FOR ON FARM BREEDING
This agreement is made and entered into on this day of , 2011, by and between ,(Mare Owner) and Meredith Shertzer/Moonraker Quarter Horses, 51320 County Rd 33, Nunn, Colorado, 80648, (Stallion Owner).

Upon signing this contract, Stallion Owner agrees to breed the Stallion, Stormin Vista Bond - Reg #3816784, to the mare Registration #, for the breeding season of at the agreed upon fee of $500 which includes a non-refundable booking fee of $150.00 to be returned with this contract. A copy of the front and back of the mare's registration certificate must accompany the signed contract. Owner recorded on registration certificate will be recorded on the stallion breeding report and breeding certificate.

The fee above includes the first cycle of the mare. All vet expenses for the mare will be the responsibility of the mare owner, including, but not limited to: ultrasounds, hormone injections, palpation exams, insemination charges if needed. There is a non-refundable fee of $200.00 for EACH additional cycle required.

The mare owner will be responsible for $7.00/day horse care fees, wet or dry, starting on the day the mare is delivered and ending on the day the mare is picked up. The remainder of the breeding fee and the cost of mare care will be due upon pick-up of the mare. The mare owner will provide a current year negative Coggins test.

The mare owner will disclose any known health concerns associated with the mare or her current year foal, if the mare is known to have difficulty becoming pregnant, carrying a pregnancy to full term, or foaling. It will also be disclosed if a mare is known to have irregular heat cycles.

The mare owner will deliver the mare to Moonraker QH in good health, proper weight, free of worms, vaccinated, and in sound breeding condition. Mares that are not halter broke will not be accepted.

The mare owner will provide any special care needs of the mare to the stallion owner prior to delivering the mare. In order to help protect the safety of the mare, the stallion, and the stallion owner, the mare owner will disclose any unusual/undesirable personality traits of the mare. This includes biting, kicking, striking, cribbing, etc.

The mare owner is responsible for removing the mare from Moonraker QH in a timely manner after the breeding service is completed and if the mare owner desires, the mare has been ultrasounded, at mare owners expense, in foal.

It is requested that mare be pregnancy checked again at 45 days and the Stallion Owner notified of her pregnancy status.

The mare owner will provide a maximum dollar amount for vet services. If the professional services of a veterinarian are required, the treatment should cease if the total costs exceed $

This cost will be incurred by the mare owner and due at the time of pick-up of the mare.

Stallion owner agrees to diligently try to settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Stallion Owner blameless. Mare Owner agrees to give Stallion Owner ample opportunity to settle mare. If mare cannot be settled, Stallion Owner will allow a substitution of mares at its discretion.

Should the stallion be sold, die or become permanently unfit for breeding, the stud fee, (minus the booking fee), and any other pre-paid fees shall be refunded in full to Mare Owner and Stallion Owner shall be held blameless.

This contract contains a "LIVE FOAL GUARANTEE". A live foal is described as a newborn foal that stands and nurses without assistance. If the foal is born dead, there will be rebreed privileges for the same mare during the current or following season only, if the Stallion Owner is notified within 10 days and receives a Veterinarian's statement confirming death. If after being pronounced "Safe in Foal" the mare should miscarry, abort or prove barren, Mare Owner has the privilege to rebreed during the current breeding season or the following season. Rebreeds will carry no Live Foal Guarantee.

For all re-breeds, Mare Owner agrees to pay any lab fees and veterinary costs. Re-breeds will be honored through the following breeding season only.

Stallion Owner will provide official AQHA or APHA forms. It is Mare Owners responsibility to mail documentation to AQHA or APHA following insemination of mare. A "Breeder's Certificate" shall be issued by Stallion Owner to Mare Owner after all expenses to Stallion Owner have been paid and at such time as they are made available by AQHA or APHA. It is the Mare Owner's responsibility to provide Stallion Owner with a valid address to which Breeder's Certificate shall be mailed.

All parties agree the Stallion Owner, their agents or employees, are not liable for death, sickness, or accident including consequential damages caused to the mare, and Mare Owner is not liable for death, sickness or accident including consequential damages caused to the stallion.

If the mare has a foal at her side, all above terms regarding health and care of the mare will apply to the foal as well. When mare owner signs and returns this contract it becomes a binding contract on both parties, subject to the above terms and conditions. This contract is not transferable or assignable. Mare owner irrevocably agrees that his/her sole recourse against Moonraker Quarter Horses with respect to the performance or non-performance of this contract is a return of the Stallion Service Fee less the booking fee. This contract is bound by the laws of the state of Colorado.
