STALLION BREEDING CONTRACT FOR SHIPPED SEMEN

which includes a non-refundable booking fee of $150.00 to be returned with this contract. The balance of the stud fee, plus shipping fees and a container deposit shall be payable no later than ten (10) days prior to semen shipment. A copy of the front and back of the mare's registration certificate must accompany the signed contract. Owner recorded on registration certificate will be recorded on the stallion breeding report and breeding certificate.
There is a non-refundable fee of $200.00 for EACH additional shipment of cooled transported semen. The 1st shipment of cooled semen is included in the stud fee. There is also a one-time refundable Equitainer fee of $350.00 which will be refunded once the Equitainer is returned. The Equitainer must be returned back within 5 business days of receipt. After five days a late fee of $10.00 per day will be deducted from the container deposit.
The Mare Owner will pay the shipping charges for regular Federal Express (Fed-Ex) overnight delivery. Alternative shipping arrangements can be made at the mare owner's expense. It is the Mare Owner's responsibility to try to coordinate shipping requests for weekday delivery.
A request for shipment of cooled transported semen must be made at least 48 hours prior to shipping time. It will be the mare owner and his/her veterinarian's responsibility to confirm our collection/shipping days.
Stallion Owner agrees to ship Mare Owner semen that will be viable for a minimum of 36 hours after leaving Stallion Owner's possession. In the event that a semen shipment does not meet insemination criteria, a licensed veterinarian must issue a written certificate documenting that the semen shipment was not suitable for use, that proper and accepted handling procedures were used during inspection process and the date and time of inspection. When Stallion Owner receives proper documentation (via fax is acceptable) a replacement shipment may be shipped to the Mare Owner at no additional cost.
Should the stallion be sold, die or become permanently unfit for semen collection, the stud fee, (minus the booking fee), Equitainer deposit and any other pre-paid fees shall be refunded in full to Mare Owner and Stallion Owner shall be held blameless.
The use of cooled semen is a new technology and no warranty or guarantee, express or implied, is given. While we strive for quality and timeliness, neither a guaranteed date/time of delivery, nor the quality of the semen at arrival is given.
Each shipping container will have enough live sperm cells to inseminate ONLY ONE MARE. Any attempt to breed more than one mare will void this contract.
The Mare Owner agrees the mare is healthy and in sound breeding condition.
This contract contains a "LIVE FOAL GUARANTEE". A live foal is described as a newborn foal that stands and nurses without assistance. If the foal is born dead, there will be rebreed privileges for the same mare during the current or following season only, if the Stallion Owner is notified within 10 days and receives a Veterinarian's statement confirming death. If after being pronounced "Safe in Foal" the mare should miscarry, abort or prove barren, Mare Owner has the privilege to rebreed during the current breeding season or the following season. Rebreeds will carry no Live Foal Guarantee.
For all re-breeds, Mare Owner agrees to pay any lab fees and deposits for shipping containers. Re-breeds will be honored through the following breeding season only. At the Stallion Owner's discression, the mare may be required to be re-bred at Moonraker Quarter Horses or Countryside Large Animal, Greeley, CO.
Mare Owner agrees to have the mare examined by an early ultrasound scan between 14 and 18 days from the last day inseminated and notify Stallion Owner of her pregnancy status. It is suggested that mare be pregnancy checked again at 45 days.
Stallion Owner will provide official AQHA or APHA forms with each shipment of semen. It is Mare Owners responsibility to mail documentation to AQHA or APHA following insemination of mare and signing by veterinarians or agent doing insemination. A "Breeder's Certificate" shall be issued by Stallion Owner to Mare Owner after all expenses to Stallion Owner have been paid and at such time as they are made available by AQHA or APHA. It is the Mare Owner's responsibility to provide Stallion Owner with a valid address to which Breeder's Certificate shall be mailed.
When mare owner signs and returns this contract it becomes a binding contract on both parties, subject to the above terms and conditions. This contract is not transferable or assignable. Mare owner irrevocably agrees that his/her sole recourse against Moonraker Quarter Horses with respect to the performance or non-performance of this contract is a return of the Stallion Service Fee less the booking fee. This contract is bound by the laws of the state of Colorado.
